Proposed changes to Order 43
NSW Coal Order 43 (Order 43) plays a critical role in ensuring that NSW coal mine workers are adequately screened for health risks that may be associated with their work, such as Coal Mine Dust Lung Disease. Coal Services is responsible for administering the Order, under the Coal Industry Act 2001 (NSW).
Industry consultation recommenced in 2023 regarding proposals to improve the health surveillance scheme for NSW coal mine workers. A new Order has been drafted based on the outcomes from these sessions (see Phase 1 Consultation below for more information).
Phase 2 Consultation
Stakeholders (including the Mining & Energy Union, the NSW Minerals Council, External Doctor Network) were invited to provide feedback on the draft Order. Feedback submissions are now closed and we thank everyone who generously gave their feedback on the proposed changes. An impact assessment is being completed.
We are now collating and reviewing the feedback and the results of the impact assessment. These responses will help us to reach a final position on how health assessments will be delivered in the new Order.
Phase 1 Consultation (complete)
Industry consultation on the proposed changes to Order 43 recommenced in August 2023.
This consultation encompassed:
- ideation sessions to define the priorities required to support the Order. Expressions of interest were sought from larger stakeholder groups to ensure all segments were represented as fairly and equitably as possible
- individual meetings with stakeholder group representatives to identify risks, dependencies and considerations in relation to proposed changes
- workshop with a small group of representatives from key stakeholder groups to discuss revisions to the existing Order.
